Assumption of Risk and Waiver of Liability

The Pluckemin Presbyterian Church (the “Church”), as part of its mission to the community, is accepting Donated Used or New Medical Equipment to be distributed to the community. The church has made only a preliminary inspection of the Donated Used or New Medical Equipment. The Church and its representatives make no representations, warranties, or guaranties about the Donated Used or New Medical Equipment, including, but not limited to, any implied warranties of merchantability and/or fitness of such equipment for any purpose.

I acknowledge and understand that I am accepting the Donated Used or New Medical Equipment "as is". After acceptance of the Donated Used or New Medical Equipment, I understand that the Church will not provide any services, replacement parts, or repairs. I further understand that there are certain risks of injury that may arise from the possession, use or misuse of the Donated Used or New Medical Equipment. I acknowledge and agree that I will make and rely upon my own inspection of the Donated Used or New Medical Equipment.

In exchange for such equipment, I release from liability and waive any right to sue the Church and its officers, agents and representatives from any and all claims in any way related to the Donated Used or New Equipment. I agree to indemnify, defend, and hold harmless the Church and its officers, agents, and representatives against any and all claims based upon, arising from, or in consequence of the Donated Used or New Medical Equipment.
